Terms of Service

These Terms of Service ("Terms") govern your access to and use of the OrbitKit.dev website and all digital products and services offered thereon ("Services"). By accessing our website or making a purchase, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Definitions
- "OrbitKit" refers to OrbitKit.dev and its operators.
- "You" / "Purchaser" refers to the individual or organization purchasing or using our products.
- "Product" / "Template" refers to any digital item sold on OrbitKit.dev, including Power Automate flows, Power Apps, SharePoint solutions, Power BI reports, and marketplace app access.
- "License" refers to the right granted to you upon purchase.
2. License Grant
Upon completing a purchase, OrbitKit grants you a non-exclusive, non-transferable, perpetual license to use the purchased product subject to the following terms:
✅ You MAY:
- Use the template within your own Microsoft 365 tenant or organization.
- Modify the template to suit your internal business needs.
- Use the template on behalf of clients (one deployment per license).
- Create backup copies for personal archival purposes.
❌ You MAY NOT:
- Resell, sublicense, or redistribute the template or derivative works to third parties.
- Share, publish, or make the template files publicly available.
- Bundle the template into a product or service for resale.
- Transfer the license to another person or organization.
- Remove or alter any copyright notices or attribution included in the product.

3. Payments & Pricing
- All prices are displayed in Indian Rupees (INR) unless otherwise stated.
- Payments are processed securely by Razorpay. By completing a purchase, you agree to Razorpay's terms of service.
- We reserve the right to change prices at any time. Price changes do not affect purchases already completed.
- All sales are final unless otherwise stated (see Section 4).
4. Refund Policy
Due to the instant digital delivery nature of our products, all sales are generally final once the download link or access instructions have been delivered to your email.
However, we will consider refund requests in the following circumstances:
- The product is materially different from what was described on its product page.
- The product contains a critical defect that renders it unusable and cannot be resolved within 7 business days of reporting.
- You were charged twice for the same order due to a technical error.
To request a refund, contact us at support@orbitkit.dev within 7 days of purchase with your order number and a detailed description of the issue.
Refunds are processed back to the original payment method within 5–10 business days.
5. Download Access
- Download links are valid for 7 days from the time of purchase and may be used up to 10 times.
- If your download link has expired, contact support within 90 days of purchase and we will reissue it at no charge.
- For marketplace-type products (AppSource, SharePoint Store, etc.), access instructions are sent to your email and are valid indefinitely.
6. Intellectual Property
All products, content, graphics, and branding on OrbitKit.dev are the intellectual property of OrbitKit and its licensors. Nothing in these Terms transfers any intellectual property rights to you other than the limited license described in Section 2. You acknowledge that OrbitKit retains all ownership of its products even after purchase.
7. Disclaimer of Warranties
OrbitKit products are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our products will be error-free, uninterrupted, or compatible with all Microsoft 365 configurations. We are not responsible for changes to Microsoft 365 APIs, licensing, or platform features that may affect product functionality after purchase.
8. Limitation of Liability
To the maximum extent permitted by applicable law, OrbitKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, business, or goodwill arising from your use of or inability to use our products or services. OrbitKit's total liability to you for any cause of action shall not exceed the amount paid by you for the product in question.
9. Account Responsibilities
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
- One person may not share an account with multiple users.
10. Modifications to Services
We reserve the right to modify, suspend, or discontinue any part of our Services at any time. We may also update products to fix bugs or improve compatibility. Material changes to purchased products will be communicated via the email associated with your order.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.
12. Changes to Terms
We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, notify you via email. Your continued use of our Services after changes constitutes acceptance of the updated Terms.
